Our Terms and Conditions
1. About these terms
1.1 These terms apply to everyone who uses thewellbeingdirectory.co.uk (the “website”), and to practitioners and businesses who list their services in our directory or buy a podcast interview. Please read them carefully. By using the website or joining the directory, you agree to these terms.
1.2 The website is run by The Wellbeing Directory Ltd, a company registered in England and Wales (company number 16260378) (“we”, “us”, “our”). You can contact us at [email protected].
1.3 In these terms, a “practitioner” means any person or business that lists their services in our directory, and a “listing” means the profile we publish for them.
1.4 Our Privacy Policy explains how we use personal information, and forms part of these terms.
2. Using the website
2.1 The website helps people find wellbeing practitioners, services and resources. The articles, videos and interviews on the website are for general information only. They are not medical, psychological or professional advice, and they don’t replace advice from your GP or a qualified professional.
2.2 Practitioners in the directory are independent. They are not our employees or agents, and any arrangement you make with a practitioner is between you and them. We review listings before they are published, but we can’t guarantee a practitioner’s qualifications, services or results. Please check that any practitioner is right for you before you book.
2.3 If you are in crisis or need urgent help, please don’t rely on the directory. Call 999 in an emergency, contact NHS 111, or call Samaritans free on 116 123, any time of day or night.
2.4 You must not misuse the website. For example, you must not try to gain unauthorised access to it, introduce viruses, send spam through our forms, or copy content from the website for commercial use without our permission.
2.5 The website may link to other websites, including practitioners’ own sites and social media. We are not responsible for the content of those websites.
3. Joining the directory
3.1 To join, choose your package and pay online. Straight after payment, you’ll receive our About Me Clarity Workbook and a link to a short form where you send us your listing details, services and photos.
3.2 By joining, you confirm that:
-
you are at least 18 and are joining for business purposes;
-
you hold the training and qualifications needed for the services you offer, and will provide evidence if we ask for it;
-
you hold appropriate professional insurance for your services;
-
where a professional or regulatory body exists for your field, you are a member in good standing or are registered with it; and
-
you will follow the law and any code of practice that applies to your work.
3.3 Once we have received your listing details, we aim to review and approve your listing within 7 days. We may ask you to change your listing before we approve it.
3.4 We are a curated directory, so we may decline an application if we don’t think it is a good fit for the directory or our community. If we decline your application, we will refund your payment in full.
4. Fees and payment
4.1 A Directory Listing costs £99 a year. The Podcast Add-On costs £49.99 per podcast. The prices shown on the website when you pay are the prices that apply. We are not VAT registered, so no VAT is charged.
4.2 Payments are taken securely by our payment provider, Stripe. We don’t see or store your full card details.
4.3 Your Directory Listing is a yearly subscription of £99. It renews automatically each year, and Stripe takes the payment on your renewal date using the payment details you gave us, unless you cancel. You can cancel at any time before your renewal date by emailing us, and your listing will stay live until the end of the year you have paid for.
4.4 We may change our prices. Any change won’t affect a period you have already paid for, and we’ll tell you before it applies to your renewal.
5. Your listing
5.1 You are responsible for the information in your listing. It must be accurate, up to date and not misleading. Please tell us promptly if anything changes.
5.2 Your listing must not make claims you can’t support, such as promising to cure or treat medical conditions. Advertising of health and wellbeing services in the UK must follow the CAP Code (the UK Code of Non-broadcast Advertising), and you are responsible for making sure your listing does.
5.3 Your listing can include up to 5 photos. You must own, or have permission to use, every photo, logo and piece of text you send us, and have permission from anyone who can be identified in your photos.
5.4 You keep ownership of your content. You give us permission to publish it on the website, and to use it on our social media, videos and newsletters to promote you and the directory, for as long as you are listed. We may resize or reformat your content, or make small edits so that it fits the directory’s style. We’ll ask you before making any change to its meaning.
5.5 We decide how the directory is organised, including the categories, the order of listings and how search works. Joining doesn’t guarantee a particular position, number of views, enquiries or clients.
6. Standards, suspension and removal
6.1 We want the directory to be a place people can trust. We may ask you to change your listing, or we may suspend or remove it, if:
-
your listing is inaccurate or misleading, or breaks these terms;
-
we receive a serious complaint about you, or have reasonable concerns about the safety or wellbeing of the people you work with;
-
you no longer meet the requirements in clause 3.2; or
-
you behave in a way that could harm the reputation of the directory or our community.
6.2 Where it’s appropriate, we’ll talk to you first and give you the chance to put things right. If we remove your listing because you have broken these terms, you won’t be entitled to a refund.
6.3 If we decide to close the directory, we’ll give you at least 30 days’ notice and refund the unused part of your fee.
7. Cancelling and refunds
7.1 If you change your mind before your listing goes live, email us and we’ll give you a full refund.
7.2 Once your listing is live, you can ask us to remove it at any time, but we don’t give refunds for the rest of the year you have paid for. To stop your subscription renewing, cancel before your renewal date, as explained in clause 4.3.
7.3 When your listing ends, we’ll remove it from the website as soon as practicable. We’ll delete your listing details within 6 months, as set out in our Privacy Policy.
7.4 Because the directory is for businesses, the 14-day cancellation period under the Consumer Contracts Regulations doesn’t apply. Nothing in these terms affects any legal rights you have that can’t be excluded.
8. Podcast interviews
8.1 The Podcast Add-On is a recorded interview of about 15 minutes introducing your business. It is featured on the website and our YouTube channel, promoted within the Busy Women Club community, and added to your directory listing.
8.2 After you pay, we’ll contact you to arrange a date. If you need to rearrange, please contact Helen as soon as you can and she will agree a new date with you.
8.3 By taking part, you agree that we may record, edit and publish the interview, including your name, image and voice, on the website, YouTube, social media and in our newsletters. We’ll own the recording, and you’re welcome to share the published interview on your own channels.
8.4 We’ll make sure the interview is edited fairly. We decide the final edit, and we may decline to publish an interview that breaks these terms or that we think isn’t suitable. In that case, we’ll refund your podcast fee.
8.5 The podcast fee is non-refundable once the interview has been recorded.
9. Our content
9.1 The website and everything we create for it belongs to us or our licensors. This includes the design, text, articles, videos, logos and the About Me Clarity Workbook.
9.2 You may use the About Me Clarity Workbook for your own business, but you must not share, sell or republish it.
9.3 You may share links to our articles, videos and your listing. If you want to use any other content, please ask us first.
10. Our responsibility to you
10.1 We’ll provide our services with reasonable care and skill. We try to keep the website available and working properly, but we can’t promise it will always be available or free of errors.
10.2 We aren’t responsible for the services that practitioners provide, or for any arrangement between a practitioner and a client.
10.3 We aren’t liable for loss of profit, loss of business or loss of opportunity, or for any loss that wasn’t reasonably foreseeable.
10.4 If we are liable to a practitioner, our total liability will be no more than the fees you have paid us in the 12 months before the claim.
10.5 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited by law.
10.6 You agree to compensate us for any claims, losses or costs we face because of the content of your listing or the services you provide.
11. Other important terms
11.1 We may update these terms from time to time, and the latest version will always be on the website. If we make a significant change that affects practitioners, we’ll email you before it takes effect.
11.2 If any part of these terms is found to be invalid, the rest will still apply.
11.3 You can’t transfer your listing or membership to someone else without our agreement.
11.4 If we don’t enforce one of these terms straight away, we can still enforce it later.
11.5 These terms are governed by the law of England and Wales, and the courts of England and Wales will deal with any dispute.
12. Contact us
If you have a question about these terms, or a complaint, please email us at [email protected]. We’ll do our best to put things right.
